Rafræn vöktun - Obiekt monitorowany – Electronic surveillence

Í hluta orlofseigna félagsins hefur verið komið á rafrænni vöktun með kerfi öryggismyndavéla. Þar sem þessi kerfi eru komin á  er það merkt á staðnum í samræmi við lög nr. 90/2018.

Samkvæmt lögum um persónuvernd og vinnslu persónuupplýsinga verður rafræn vöktun að vera í málefnalegum tilgangi og um meðferð þeirra upplýsinga sem fást við vöktunina fer eftir ákveðnum reglum. Hér að neðan verður gerð grein fyrir tilgangi vöktunar á orlofssvæðum félagsins og hvernig meðferð upplýsinga úr öryggiskerfum félagsins er háttað.

  • Ástæður vöktunar.
    • Megintilgangur vöktunarinn er að verja öryggi félagsmanna AFLs, gesta þeirra og eignir þeirra og AFLs.
    • Í því felst að tilgangur vöktunar að fylgjast með því að óviðkomandi aðilar hafi ekki aðgang að húsinu.
    • Þá áskilur AFL sér rétt til að skoða umgengni leigutaka um sameign hússins, þ.m.t. sorpgeymslu, bílakjallara og hjólageymslu.
  • Framkvæmd.

Í orlofseign AFLs að Stakkholti eru myndavélar  staðsettar á tveimur stöðum utandyra á jarðhæð, á þremur stöðum í bílakjallara, á öllum stigapöllum og tvær myndavélar eru á hverri hæð á göngusvölum. Þá er myndavél í sorpgeymslu og í hjólageymslu / tækjarými. Alls eru þetta 19 myndavélar.

  • Vistun upplýsinga.

Allar myndavélarnar eru ætíð stilltar á upptöku. Hver upptaka er geymd í 90 daga og er þá sjálfkrafa eytt. Vistað myndefni er geymt á vefþjóni í eigu og umsjón AFLs og tryggt er að óviðkomandi hafi ekki aðgang að myndefninu.

  • Aðgangur að myndefni.

Einungis tveir starfsmenn AFLs munu hafa aðgang að myndefni úr öryggismyndavélunum. Þessum tveimur starfsmönnum AFLs verður óheimilt að skoða upptökur úr myndavélum nema af tilgreindri ástæðu og ber þeim að færa skrá yfir alla skoðun á myndefni á vefþjóni. Beinist skoðunin að einhverjum tilteknum einstakling ber að tilkynna viðkomandi að myndefni hafi verið skoðað og tilgreina þá ástæðu sem var fyrir skoðuninni.

  • Eftirlit í rauntíma.

Þeir starfsmenn AFLs sem aðgang hafa að myndavélunum munu mögulega skoða umferð um eignir félagsins tilviljanakennt í stutta stund hverju sinni.  Það eftirlit mun ekki beinast að neinum sérstökum einstakling og því ekki tilkynningarskylt.

  • Réttur þeirra sem fylgst er með.

Þeir aðilar sem fylgst er með hafa rétt á aðgangi að því efni sem skráð hefur verið um þá nema hagsmunir annarra vegi þyngra. Þar sem myndefni verður ekki skoðað skipulega og ekki færð skrá um hverjir eru í myndefninu  lítur AFL ekki svo á að unnið sé frekar með upplýsingar um tilgreinda einstaklinga. Komi til þess að sérstök skoðun fari fram á t.d. umferð í kringum tiltekna íbúð telst það vinnsla persónugreinanlegra upplýsinga um þá sem þar dveljast og fær þá leigutaki upplýsingar um að skoðun hafi farið fram. Munu þeir sem skoðaðir voru sérstaklega þá jafnframt eiga rétt á að skoða það myndefni sem safnað var af þeim.

  • Hverjir fá aðgang að upplýsingum.

AFL mun ekki afhenda þriðja aðila myndefni úr öryggismyndavélum nema lög heimili. Óski lögreglan eftir myndefni í tengslum við rannsókn á afbroti mun AFL veita lögreglu fullan aðgang að umbeðnu myndefni. Telji t.d. einstaklingur að skemmdir hafi verið unnar á bíl hans í bílageymslu hússins fær viðkomandi ekki aðgang að myndefni úr öryggismyndavél. Starfsmaður AFLs mun skoða upptökur og gera síðan lögreglu viðvart, telji starfsmaðurinn augljóst af myndefni að skemmdir hafi verið unnar á bílnum. Óski lögreglan eftir upptökunum verður orðið við því.

  • Ábyrgðaraðili og málskotsréttur.

Framkvæmdastjóri AFLs er ábyrgðaraðili öryggismyndavéla og ber ábyrgð á því að uppsetning, starfssemi og úrvinnsla rafrænnar vöktunar sé í samræmi við lög og reglur.  Telji félagsmaður AFLs brotið á sér með starfrækslu kerfisins er viðkomandi bent á að hafa samband við persónuverndarfulltrúa félagsins og fá þar ráðgjöf.

 

Monitoring wizyjny nieruchomości wakacyjnych Związków zawodowych AFL

W wybranych obiektach wakacyjnych AFL wdrożono monitoring wizyjny z systemem kamer bezpieczeństwa, które zgodnie z prawem zostały odpowiednio oznaczone.

Zgodnie z ustawą nr 90/2018 o ochronie i przetwarzaniu danych osobowych, nadzór elektroniczny musi być uzasadniony, a przetwarzanie pozyskanych w ten sposób danych podlega określonym zasadom. 
Poniżej zostanie przedstawiony cel wdrożenia monitoringu na terenie obiektów wakacyjnych AFL oraz metoda przetwarzania danych.  

  • Cel monitoringu
    • Głównym celem monitoringu jest ochrona bezpieczeństwa członków AFL, ich gości oraz mienia należącego zarówno do nich, jak i do Związków zawodowych AFL.
    • Obejmuje to m.in. sprawdzanie tego, czy osoby nieupoważnione nie mają dostępu do danego obiektu.
    • AFL zastrzega sobie prawo do monitorowania części wspólnych obiektu w celu sprawdzenia poprawności ich użytkowania przez najemców. Należą do nich m.in. parking podziemny, przechowalnia rowerów, pomieszczenie z pojemnikami na odpady.
  • Realizacja
    W obiekcie wakacyjnym AFL w Stakkholt kamery rozmieszczone są na zewnątrz budynku:
    w dwóch miejscach na parterze, w trzech miejscach w parkingu podziemnym, na wszystkich schodach oraz na każdym piętrze na zewnętrznych klatkach schodowych, na których zostały umieszczone dwie kamery. Jedną kamerę zamontowano w pomieszczeniu z pojemnikami na odpady, a drugą w przechowalni sprzętu i rowerów. W sumie 19 kamer.
  • Przechowywanie danych

Wszystkie kamery są zawsze ustawione na nagrywanie. Materiał przechowywany jest przez okres 90 dni, a następnie automatycznie usuwany. Zapisane nagrania są przechowywane na serwerze należącym i obsługiwanym przez AFL, co gwarantuje brak dostępu do nagrań osobom do tego nieupoważnionym.

  • Dostęp do nagrań

Tylko dwóch pracowników AFL ma dostęp do nagrań z kamer bezpieczeństwa. Osoby te nie mogą oglądać nagrań z monitoringu bez określonego powodu i zobowiązani są do prowadzenia rejestru wszystkich nagrań oglądanych na serwerze. W przypadku gdy przegląd nagrania ma związek z konkretną osobą, należy powiadomić tę osobę o podjęciu takich czynnościach
i przedstawić celowość tych działań. 

  • Monitorowanie w czasie rzeczywistym
    Pracownicy, którzy mają dostęp do nagrań z monitoringu będą prawdopodobnie oglądać przez krótki czas losowo wybrane nagrania z kamer bezpieczeństwa na terenie obiektu. Monitoring ten nie będzie skierowany na konkretną osobę, dlatego też nie podlega obowiązkowi zgłoszenia.

 

  • Prawa osób monitorowanych

Osoby monitorowane mają prawo dostępu do nagrań na których się znajdują, chyba że interesy osób trzecich mają znaczenie nadrzędne. Ponieważ materiał z nagrań nie będzie przeglądany
w żaden zorganizowany sposób i nie będzie prowadzona ewidencja osób znajdujących się na nagraniach, uważa się, że jakiekolwiek dalsze przetwarzanie informacji dotyczące konkretnych osób nie będzie miało miejsca. Jeśli natomiast zajdzie potrzeba kontroli ruchu, np. wokół określonego mieszkania, będzie to traktowane jako przetwarzanie danych osobowych osób przebywających w  danym miejscu w określonym czasie i zostaną one poinformowane
o zaistniałej sytuacji.

  • Osoby, które mają dostęp do informacji

AFL nie udostępnia nagrań z monitoringu osobom trzecim, chyba że prawo na to zezwala. Jeżeli policja zażąda materiałów w związku z prowadzonym dochodzeniem, AFL zapewni pełny dostęp do żądanych nagrań. Natomiast jeśli dana osoba uważa, że np. jej samochód został uszkodzony w parkingu podziemnym budynku i zażąda wglądu do zapisu z kamery monitoringu, nie uzyska takiego pozwolenia. Zamiast tego pracownik AFL obejrzy nagranie z kamery i powiadomi policję, jeśli uzna, iż materiał wyraźnie wskazuje na to, że samochód został uszkodzony. Prośba policji
o udostępnienie nagrania zostanie spełniona.

  • Strona odpowiedzialna i prawo do odwołania

Dyrektor administracyjny AFL odpowiada za instalację i obsługę kamer bezpieczeństwa oraz za  to, by proces przetwarzania materiałów pochodzących z monitoringu wizualnego był zgodny
z prawem i przepisami. Jeżeli członek AFL uważa, że poprzez działanie systemu naruszone zostały jego prawa, proszony jest o skontaktowanie się ze związkowym Inspektorem ochrony danych w celu uzyskania porady.

 

Electronic monitoring at the vacation properties of AFL - the Union of General and Special Workers in East Iceland

Some parts of the AFL vacation properties are now equipped for electronic monitoring with a security camera system. Where this is the case, it has been labelled on site, in keeping with law.

According to Act No. 90/2018, on Data Protection and the Processing of Personal Data, electronic surveillance must have an objective purpose, and the processing of data thereby obtained is subject to certain rules. The purpose of surveillance in AFL vacation areas is explained below, as well as how data from the security systems is processed.

  • Reasons for surveillance
    • The main purpose of this surveillance is to protect the security of AFL members and of their guests and property, as well as AFL property.
    • That involves checking that no unauthorised parties have access to this building.
    • AFL also reserves the right to observe how renters treat common areas, including the rubbish storage room, basement car park and bicycle storage room.
  • Arrangements on site

At the AFL vacation property in Stakkholt, cameras are positioned at two outdoor spots on the ground floor, three places in the underground car park, on every stair landing and at two locations per floor in the outdoor passageways. One camera is located in the rubbish storage room and another in the equipment and bicycle storage room. The total is 19 cameras.

  • Data storage

All of the cameras are set for continuous recording. All of the footage is kept for 90 days and is then automatically deleted. The stored photographic material is kept on a server owned and supervised by AFL, ensuring that no unauthorised parties obtain access to the material.

  • Access to the photographic material

There are only two AFL employees who have access to photographic material from the security cameras. These two AFL employees are not permitted to examine the camera footage without a specified reason; furthermore, they shall log each examination of photographic material that is on the server. If such an examination is directed at a particular individual, s/he shall be notified that the material has been examined and what the reason was for this examination.

  • Real-time checks

The AFL employees who are able to access the cameras might sometimes check on movements through union property; these checks would be random and only of brief moments. Such checks would not be directed at any particular individual and do not require notification.

  • The rights of those monitored

Those who are being monitored have the right to access the material recorded of them unless the interests of other people matter more. Since the photographic material will not be examined in any organised manner and no records will be kept of those appearing in it, AFL is not of the opinion that any further processing occurs of data on particular individuals. If a special examination does occur, for instance of movements around a particular apartment, then that shall be considered a processing of personally identifiable data regarding those staying there at the time. The renter shall be informed of the examination having occurred, and those who were particularly examined shall thereby be entitled to examine the photographic material that was recorded of them.

  • Those who can obtain access to the information

AFL will not hand over the photographic material from the security cameras to any third party unless this is legally permissible. If the police request such material due to a criminal investigation, AFL will provide the police with full access to the requested material. If an individual believes for example that her/his car was damaged in the building's underground car park, this person will not receive access to photographic material from the security camera. Instead, an AFL employee will examine the camera footage and notify the police if this employee feels the photographic material clearly shows that damage was done to the car. A police request for this footage would be complied with.

  • Responsible party; right of recourse

AFL's general manager is the party responsible for security cameras and for their installation and operation, as well as for compliance with laws and regulations when material from electronic monitoring is being processed. Should an AFL member feel that s/he has been infringed upon through the system's operation, s/he is requested to contact the union's data protection officer for advice.
